Trends in the Innovationalisation of Law

Abstract


The article is devoted to the study and interpretation of trends in the Innovationalisation of Law. This is due to the fact that the target interdisciplinarity of many modern technological innovations predetermines the objective need for their succeeding regulatory support and accompaniment, as a consequence - it entails the need to address the question of the future in the field of law. The author refers to the nature and meaning of legal innovations, explains the concept of legal innovations. The author identifies a number of trends in the current (with extrapolation to the subsequent, to the future) development of law, which he associates with innovation. Among them, the author dwells in more detail on the following trends: 1) the trend of progressive increase in the technologization of professional legal activity; 2) the trend of increasing complexity of the ontology of law and regulatory spaces; 3) the trend of ontological simplification of law. According to the author's position, there are many different reasons for the increasing complexity of law and law in general, as well as reasons for the prerequisites of non-linear growth of complexity. The tendency of increasing complexity and entropy (chaotization, confusion, disorderliness) of legislation is due to the very specifics of the phenomenon of law; and objectively, the trends of increasing complexity of regulatory landscapes, regulatory environments cannot but be accompanied and counterbalanced by trends of their forced streamlining and simplification. The author concludes that the predictable future in the sphere of law (achieved by active positive and proactive construction of the legal order and legal space) is not predetermined, its achievement requires the application of certain significant efforts. The article proposes a number of measures that predictively order the described trends.
